CUANDO LAS MUJERES HABLAN. MANIFIESTO CONTRA LA VIOLENCIA OBSTÉTRICA

La Violencia Obstétrica se define como una forma específica de violencia ejercida por profesionales de la salud (predominantemente personal médico y de enfermería) hacia las mujeres embarazadas, en labor de parto y el puerperio. Constituye una violación a los derechos reproductivos y sexuales de las mujeres.

La Violencia Obstétrica atenta contra los derechos humanos de las mujeres por el mero hecho de serlo, contra su dignidad e integridad, con el agravante de la especial vulnerabilidad que se da en las circunstancias que rodean a la reproducción.

El Comité para la eliminación de la discriminación contra la mujer (CEDAW) de Naciones Unidas ha emitido hasta el momento dos dictámenes referidos al Estado Español, el primero en 2020 y el segundo en 2022, en los que concluye que las mujeres que han llevado sus casos hasta la ONU sufrieron violencia obstétrica.

Estas causas fueron desestimadas por la justicia española. En cambio, el Comité de la ONU, al analizar las denuncias presentadas valora que se trata de casos de "violencia obstétrica" y añade que "las autoridades administrativas y judiciales aplicaron nociones estereotipadas y discriminatorias para desestimar las demandas" (argumentando que es el médico quien decide la cesárea o que las lesiones psicológicas son una mera percepción de la madre).

La respuesta ante ambas resoluciones por parte tanto de las instituciones estatales como autonómicas correspondientes, resulta especialmente preocupante. En lugar de seguir las directrices -realizar un análisis de la situación e invertir en formación específica dirigidas a profesionales de la sanidad y justicia- se han limitado a negar los hechos.

Las asociaciones firmantes de este manifiesto somos conocedoras del impacto y la incidencia de la Violencia Obstétrica y también de las dificultades para su reconocimiento (requisito necesario para poder abordar sus causas y dar cabida a medidas que las corrijan).

Con esta campaña, pretendemos visibilizar las experiencias de Violencia Obstétrica en España como una vulneración de los derechos básicos de las mujeres y, en especial, de aquellos que protegen su salud sexual y reproductiva.

Por esto, os invitamos a compartir vuestras experiencias de Violencia Obstétrica publicándolas en RRSS con los hashtag #EstoEsViolencia, #ViolenciaObstetrica. Así mismo, os animamos a remitir los relatos a la consejería de sanidad de la comunidad autónoma correspondiente, mediante el sistema de reclamación y quejas, así como a la institución que actúe como Defensor del Pueblo a nivel autonómico, con el fin de conseguir que lleguen estas experiencias a los gestores sanitarios y responsables de la defensa de nuestros derechos como usuarias del sistema sanitario.

Ya es hora de que acabemos con esta violencia que, como violencia machista, es estructural y no casos puntuales de mala praxis, como algunos colectivos sanitarios han pretendido defender. Muchas de nosotras, demasiadas, hemos sufrido violencia obstétrica en primera persona. Por ello, hacemos un llamamiento a toda la sociedad, para que se reconozca, visibilice, denuncie, se legisle y empecemos a luchar juntas contra esta lacra.

MANIFESTO AGAINST OBSTETRIC VIOLENCE

Obstetric Violence is defined as a specific form of violence exercised by health professionals (mainly medical and nursing staff) against women during pregnancy, labor and puerperium. It constitutes a violation of women’s reproductive and sexual rights.

Obstetric Violence violates the human rights of women for the mere fact of being women -sexist violence-, against their dignity and integrity, with the aggravating factor of specific vulnerability which takes place due to circumstances surrounding reproduction.

So far, the United Nations Committee for the Elimination of All Forms of Discrimination against Women (CEDAW) has issued two rulings regarding Spain: first in 2020 and then in 2022. These rulings conclude that the women who have submitted their cases to the UN suffered obstetric violence.

These cases were dismissed by the Spanish Courts. In contrast, the UN Committee, after analyzing the complaints, has assessed that these are cases of "obstetric violence" and adds that "the administrative and judicial authorities applied stereotyped and discriminatory notions to dismiss the claims" (arguing that it is the doctor who decides on a cesarean section or that the psychological injuries are a mere perception of the mother).

The response to both decisions by the corresponding state and regional institutions is particularly worrying. Instead of following the instructions to carry out an analysis of the situation and invest in specific training for health and legal professionals, they have simply denied the facts.

The associations signing this manifesto are aware of the impact and incidence of Obstetric Violence and also of the difficulties in achieving acknowledgment (a necessary requirement to address its causes and provide measures to correct them).

With this campaign, we intend to expose the experiences of Obstetric Violence in Spain as a violation of women’s basic rights and, especially, of those persons who protect their sexual and reproductive health.

Therefore, we encourage you to share your experiences of Obstetric Violence by publishing them through social media with the hashtag #ThisIsViolence #ObstetricViolence. Likewise, we encourage you to send these detailed accounts to the Health Department of the corresponding Regional Government (Comunidad Autónoma), using the system of claims and complaints, as well as to the institution that acts as Ombudsman at a regional level, in order for these experiences to reach Health Managers and all those responsible for the defense of our rights as users of the health system.

It is time that we put an end to this violence which, like gender/male violence, is structural and not isolated cases of malpractice, as some healthcare groups have tried to defend. Many of us, too many, have personally suffered obstetric violence. Therefore, we call on society as a whole to acknowledge, make visible, report, and legislate together against this threat/injustice.
